Cartwright Textiles on Cartwright Furniture

Listed yardage requirements for Cartwright Furniture are based on 54" plain fabric. Fabric that requires matching, narrow fabric, and velvets require additional yardage, contact factory.

Prices
All prices are list prices f.o.b. factory (High Point) and include complete packing. We reserve the right to change prices without prior notice.

Terms
Net 30 days from date of invoice. Invoices are delinquent if not paid in thirty (30) days from date of invoice. In the event timely payment is not made, interest will be charged at the rate of 1% per month on delinquent accounts. Buyers will also be liable for normal collection costs and attorney's fee.

Credit
CIT/Commercial Service Inc. (P.O. Box 31307, Charlotte, N.C. 28231) serve as our factors. They will open an account for buyers satisfactorily rated with a recognized credit agency. If a buyer is not so rated and wishes to open an account, name and address of bank and trade references must be submitted to CIT. Allow for delay for credit check.

Orders
Orders are only accepted by issuance of our formal acknowledgment and are subject to the terms set forth herein and on our order acknowledgment.

Claims
We are not responsible for damage suffered in transit. Merchandise should be inspected for possible freight damage upon delivery. Claims for damage or shortage should be filed by the consignee with the carrier within 5 days of delivery. You are also protected for "concealed damage" if you file claim with the carrier within 5 days of delivery. All claims against Cartwright for defects, errors or shortages must be made by buyer in writing within 10 days after delivery. Failure to make such claim shall constitute full acceptance.

Returns
No merchandise may be returned without our written consent and shipping instructions. Unauthorized returns will not be accepted and will be returned freight collect. Return merchandise must not have been cut or marked. Only orders of 5 yards or more may be returned and all returns will be subject to a 20% restocking charge.

Partial Shipments
We will make every attempt to ship orders complete and on schedule. However, we reserve the right to make partial shipments as merchandise is ready. Invoices covering these shipments are to be paid as they become due.

Order Change - Cancellations
Our order confirmation is final and binding. Any order change or cancellation is subject to our ability to conform. Such requests are to be made in writing to our office (High Point).

Shipping and Prepaid Freight
Unless otherwise instructed, we reserve the option to ship by what is, in our opinion, the best possible way. Upon request we will prepay freight for accounts with established credit. A service charge of 10% of the freight bill, not to exceed $50.00, will be added.

Delivery
We are not liable for delay or failure of delivery due to strikes and/or differences with workmen, war, riot, fire, compliance with government regulations, acts of God, failure or delay of sources of supply, or any other causes beyond our control.

Storage
If buyer cannot accept delivery when merchandise is ready, we reserve the right to transfer goods to storage. Costs of transfer and storage will be charged to the buyer's account, and we will deem such transfer as constituting shipment for all purposes, including invoicing, as of date transfer is made.

Construction - Specifications
All items are produced to price list specifications unless otherwise advised. Manufacturer reserves the right to make modifications and/or improvements without prior notice.

Minimum Orders
There is no minimum order size for fabric. Minimum order size for leather is one-half hide, or approximately 25-30 sq. ft.

Flame Retardant Finish/Fabric
All Cartwright Textiles upholstery fabrics are manufactured to comply with the California Upholstered Furniture Flammability Code Bulletin 117, revised February 1975 (117-75). However, Cartwright Textiles does not warrant or assume any responsibility for flame retardant properties or compliance with any flammability standards, or issue any certificate regarding flammability, and any such warranty is hereby disclaimed and excluded. In case of doubt, we suggest a sample be submitted to fire regulatory authorities having jurisdiction over the installation site. Cartwright Textiles takes no responsibility for determining the applicable flammability regulations or compliance with those regulations by the finisher. Generally, the finisher issues a notarized certificate to the customer covering the work done. When arranging for flame retarding, the customer must advise as to: 1. Installation location (town, city, state or specific regulation fabric is subject to, i.e. aircraft regulation number and type of aircraft). 2. Application of fabric (upholstery, drapery, wallcovering, etc.). Generally, finishers are unable to process Leather, Vinyl, Polyester or fabrics of 72" and more in width. Typically, flame retarding requires at least 15 days for processing. Processing and handling: contact factory for pricing. Due to fabric shrinkage in the processing of special finishes, 5% extra per pattern per order must be purchased to assure the customer's yardage requirements.

Warranty
Cartwright Textiles is not responsible for dye lot variations or discrepancies in width of fabrics. Fiber content and/or yarns may be substituted at our discretion. Sources may be changed when deemed necessary without notification. Cartwright Textiles does not warrant, guarantee, or represent an exact match to cuttings, memos, or any samples of fabric or leather. Leather may contain certain natural marks, grain and shade variations within hides considered by Cartwright Textiles to be inherent characteristics. In any event, Cartwright Textiles' responsibility will be limited to either replacement of merchandise or refund of purchase price at our option. Under no circumstances will Cartwright Textiles be responsible for any consequential damages, charges, costs, expenses, or obligations. Cartwright Textiles makes no warranty of merchantability or fitness for any purpose, either expressly or by implication.
